Who We Are and How This Policy Applies
This Privacy Policy explains how Trendwise Business Services, a trade name of K. McKay Larsen EA, Ltd. (“Trendwise,” “we,” “us”), collects, uses, shares, and protects personal information.
We act in two different capacities, and your rights differ depending on which applies:
(a) As a business collecting information about our own visitors, prospects, and clients. When you visit trendwisebizservices.com, submit an inquiry, or become our client, we decide how your information is used. This Policy governs that information directly.
(b) As a service provider processing information on behalf of our clients. When one of our clients uses the Trendwise Platform to operate their own website, customer database, and messaging, the individuals in that database are our client’s customers, not ours. We process that information only on our client’s instructions. If you are a customer of a business that uses our Platform, that business — not Trendwise — determines how your information is used, and you should direct privacy requests to them. Section 8 explains this in more detail.
What We Collect and How
2.1 Information you provide directly
- Contact information — name, business name, email address, mailing address, and telephone number, including mobile telephone number
- Inquiry content — the substance of messages you send through our contact form, by email, or by text
- Onboarding information — where you become a client: business details, hours, services, pricing, brand assets, social media links, existing website information, and testimonials or reviews you supply
- Payment information — processed by our third-party payment processor. We do not store full payment card numbers.
- Consent records — the date, time, method, and exact language of any consent you provide to receive communications
2.2 Information collected automatically
- IP address, browser type and version, operating system, and device type
- Pages viewed, referring URL, and time spent
- General geographic location inferred from IP address
- Cookie and similar technology identifiers
2.3 Information from AI chat interactions
If you interact with an automated chat widget on our Site, we collect the content of that conversation along with any contact details you provide within it. Chat conversations may be reviewed by our personnel and are used to respond to you and improve the accuracy of our automated responses.
2.4 Information we do not seek
We do not intentionally collect Social Security numbers, financial account numbers, government identification numbers, health information, or other sensitive personal information through the Site or the Platform. Do not submit such information through a contact form or chat widget.
Note regarding our tax practice: K. McKay Larsen EA, Ltd. separately operates an enrolled agent practice. Taxpayer information collected in the course of that practice is governed by federal confidentiality law, including Internal Revenue Code § 7216, and by the separate engagement letter for those services. It is not governed by this Policy and is not used for marketing purposes absent separate written consent meeting the requirements of that law.
How We Handle Your Mobile Number
3.1 What we collect
We collect the mobile telephone numbers you provide to us and the associated consent records described in Section 2.1.
3.2 How we use it
We use your mobile number to send:
- Transactional and account messages — onboarding notices, build status updates, appointment confirmations and reminders, billing notices, and support responses
- Conversational messages — replies to messages you send us
- Marketing messages — offers and updates about our services, sent only where you have separately provided express written consent for marketing
Message frequency varies. Message and data rates may apply. Reply STOP to opt out, START to resume, or HELP for assistance.
3.3 Sharing of mobile information — we do not
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
We use third-party telecommunications and messaging infrastructure providers solely to transmit messages on our behalf. These providers are contractually restricted to using the information only to deliver our messages and may not use it for their own purposes. This is not a sale or a sharing of your information for marketing.
3.4 Retention of consent records
We retain mobile numbers and consent records for at least four (4) years following the last message sent to that number, in order to evidence compliance with applicable telecommunications law. We retain opt-out records indefinitely so that we do not contact you again after you have opted out.
Purpose of Collection
We use personal information to:
- Respond to inquiries and provide requested information
- Deliver, configure, maintain, and support the services you purchase
- Process payments and manage billing and subscriptions
- Send transactional, account, and service-related communications
- Send marketing communications where you have consented
- Improve our Site, services, and automated response quality
- Detect, prevent, and investigate fraud, abuse, and security incidents
- Comply with legal obligations and enforce our agreements
Legal bases. Where required by applicable law, we rely on: your consent (marketing communications), performance of a contract (delivering purchased services), our legitimate interests (securing and improving our services), and compliance with legal obligations.
Disclosure and Third Parties
We share personal information only as follows:
- Service providers. We use third parties to host our Site, provide security and content delivery, operate our customer relationship and marketing automation infrastructure, process payments, transmit email and text messages, and integrate external workflows. These providers may access personal information only as necessary to perform services for us and are contractually restricted from using it for their own purposes.
- Legal requirements. We may disclose information where required by law, subpoena, court order, or governmental request, or where we reasonably believe disclosure is necessary to protect our rights, investigate fraud, or protect the safety of any person.
- Business transfers. If we are involved in a merger, acquisition, or sale of assets, personal information may be transferred as part of that transaction. We will provide notice before your information becomes subject to a materially different privacy policy.
- With your direction. We share information where you ask us to.
We do not sell personal information, and we have not sold personal information in the preceding twelve months. We do not share personal information with third parties for their own direct marketing purposes. We do not disclose mobile opt-in data or consent to any third party.
Cookies and Similar Technologies
We use cookies and similar technologies for:
- Strictly necessary functions — security, load balancing, and session management
- Analytics — understanding how visitors use the Site in aggregate
Most browsers let you refuse or delete cookies through their settings. Disabling strictly necessary cookies may impair Site function.
Do Not Track. Our Site does not currently respond to browser Do Not Track signals, as no common standard has been adopted.
How Long We Keep Your Information
We retain personal information for as long as necessary to fulfill the purposes described in this Policy, unless a longer period is required by law.

Information We Process on Behalf of Our Clients
Our clients use the Trendwise Platform to operate their own websites, contact forms, chat widgets, customer databases, and messaging campaigns. Information about our clients’ customers flows through that Platform.
In relation to that information:
- Our client is the party that decides what data is collected and how it is used. We are a service provider acting on our client’s instructions.
- We do not use our clients’ customer data for our own marketing, do not sell it, and do not share it with other clients.
- We process it only to provide, maintain, secure, and support the Platform.
- We retain it for the duration of the client’s engagement plus the thirty-day export window described in our Terms of Service.
If you are a customer of a business that uses our Platform and you want to access, correct, or delete your information, or opt out of that business’s messages, contact that business directly. They control your record.
Consent responsibility. Our clients are contractually required to obtain all consents necessary to contact their customers and to warrant that their contact lists were obtained directly from those individuals. We do not independently verify the consent status of records our clients provide. See Terms of Service § 7.
How to Exercise Your Rights
9.1 Available to everyone
- Access — request a copy of the personal information we hold about you
- Correction — ask us to correct inaccurate information
- Deletion — ask us to delete your information, subject to legal retention obligations
- Marketing opt-out — unsubscribe from marketing email via the link in any message, or reply STOP to any marketing text
- Communication preferences — ask us to limit how we contact you
Contact us using Section 13. We will respond within forty-five (45) days. We may need to verify your identity before acting. We will not discriminate against you for exercising any privacy right.
9.2 Nevada residents
Nevada law (NRS 603A.300 et seq.) gives Nevada consumers the right to direct a business not to sell certain covered personal information. We do not sell personal information as defined by that statute. You may nonetheless submit a verified request by emailing us at the address in Section 13 with the subject line “Nevada Opt-Out Request.”
9.3 California residents
If you are a California resident, you may have additional rights under the California Consumer Privacy Act, including the right to know the categories of personal information collected, the right to delete, the right to correct, and the right to opt out of sale or sharing. We do not sell or share personal information as those terms are defined by the CCPA. You may designate an authorized agent to submit a request on your behalf. Submit requests using Section 13.
9.4 Other jurisdictions
Several states have enacted comprehensive privacy statutes granting similar rights. If you reside in such a state and believe you have rights we have not honored, contact us and we will address your request in accordance with applicable law.
How We Protect Your Information
We use commercially reasonable administrative, technical, and physical safeguards to protect personal information, including encrypted transmission, access controls limiting internal access to personnel who need it, and vendor agreements requiring appropriate security.
No method of transmission or storage is completely secure. We cannot guarantee absolute security. You transmit information to us at your own risk. If we become aware of a breach affecting your personal information, we will notify you as required by applicable law.
Children’s Privacy
The Site and services are intended for businesses and adults. We do not knowingly collect personal information from anyone under sixteen (16). If we learn we have collected such information, we will delete it. If you believe a child has provided us information, contact us.
Policy Updates
We may update this Policy at any time. When we do, we will revise the “Last Updated” date above. For material changes, we will provide prominent notice on the Site and, where we have your contact information and the change affects you materially, by email or text.
